1. Agreement and scope

These Terms of Service form a binding agreement between you and the Yovela operator identified in the app-store listing or other service notice presented to you. They apply to Yovela's applications, websites, interactive stories, character and creator tools, digital items, and related services (together, the Services). Our Privacy Policy, Data Policy, community or creator rules, and feature-specific notices are part of this agreement where they apply.

By creating an account, selecting an acceptance control, or using the Services, you agree to these terms. If you do not agree, do not use the Services. Mandatory rights available to you under local law are not excluded by these terms.

2. Eligibility and accounts

You must meet the minimum age shown in the applicable app-store listing and any higher age required by local law. If you have not reached the age of legal majority, your parent or legal guardian must agree where local law requires it. You may not use the Services if doing so is unlawful or if we have previously suspended you and have not authorized your return.

Provide accurate information, keep it current, protect your credentials, and do not sell, rent, transfer, or share account access. You are responsible for activity under your account to the extent permitted by law. Notify support promptly if you suspect unauthorized access.

3. What Yovela provides

Yovela provides entertainment experiences built around interactive stories, simulated characters, user-created material, and automated AI systems. Features, characters, models, prices, limits, and availability may differ by device, region, account, or release and may change over time.

Simulated characters are not real people and do not possess consciousness, feelings, intentions, or professional qualifications. The Services are not an emergency service and are not a substitute for medical, mental-health, legal, financial, or other professional advice.

4. Your content

You may submit messages, prompts, choices, profiles, stories, characters, rules, images, comments, reports, and other material (Your Content). You retain any ownership rights you have in Your Content and remain responsible for it.

You represent that you have the rights and permissions needed to submit Your Content and that it does not violate law, these terms, or anyone else's intellectual-property, privacy, publicity, contractual, or other rights. Do not submit confidential or highly sensitive personal information that is not needed for the experience.

5. Private, shared, and public creations

Creator tools may let you keep a creation private, share it by invitation or link, or publish it. Every creation remains subject to these terms and our safety rules, regardless of visibility. Private content may be processed automatically for operation and safety. Shared or public content may be reviewed before or after publication by automated systems or authorized reviewers.

Publication or continued availability is not an endorsement, verification, or guarantee that a creation is lawful, accurate, or suitable. You are responsible for choosing an appropriate visibility setting and for understanding that people who can view shared or public content may copy or reshare it.

6. License for Your Content

You grant Yovela a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, format, adapt, translate, transmit, display, and otherwise process Your Content only as reasonably necessary to provide, personalize, secure, moderate, maintain, and improve the Services; comply with law; and honor the visibility and sharing choices you make.

This license lasts while Your Content is stored with the Services and for a reasonable period afterward in protected backups or records retained for legal, safety, or operational purposes. A license for public or shared content also continues as needed for lawful uses already made by others before removal. Nothing in these terms grants Yovela ownership of Your Content.

7. AI-generated content

Outputs are generated automatically from your inputs, story context, system rules, and statistical patterns. They may be inaccurate, incomplete, inconsistent, offensive, unexpected, or similar or identical to outputs provided to someone else. A character description, prompt, or setting does not guarantee a particular response.

As between you and Yovela, and to the extent permitted by law, you may use output generated for you. Yovela does not promise that output is unique, eligible for copyright, non-infringing, or appropriate for your intended use. You must review output and use independent judgment before relying on, publishing, or sharing it. AI output does not represent Yovela's views.

8. Prohibited content and conduct

You may use the Services only for lawful, authorized purposes. You must not submit, request, generate, publish, distribute, or facilitate content or conduct that:

• Sexually exploits or endangers a minor, depicts sexual content involving minors, grooms a minor, or otherwise facilitates child abuse.
• Promotes or provides actionable assistance for suicide, self-harm, terrorism, violent extremism, trafficking, weapons acquisition, fraud, hacking, malware, or other serious wrongdoing.
• Is unlawful, threatening, harassing, defamatory, hateful, or discriminatory, or promotes violence against a protected person or group.
• Violates privacy, publicity, intellectual-property, contractual, or other rights, including by exposing personal information without authorization.
• Impersonates a real person or misuses a person's name, likeness, voice, or identity to deceive, exploit, harass, defraud, or cause reputational harm, including through misleading synthetic media.
• Contains spam, unauthorized advertising, scams, deceptive engagement, or attempts to manipulate rankings, rewards, referrals, payments, or usage limits.
• Introduces malicious code, scrapes or copies the Services without permission, overloads infrastructure, probes vulnerabilities, gains unauthorized access, or bypasses moderation, safety, billing, or technical controls.
• Uses the Services or output to make fully automated high-impact decisions about another person's legal rights, employment, credit, housing, insurance, education, or access to essential services without lawful safeguards and meaningful human review.
• Otherwise creates a material risk of harm to users, Yovela, or the public.

9. Moderation, reporting, and enforcement

We may use automated tools and authorized human review to investigate reports, enforce these terms, and protect the Services. We may reject, restrict, label, reduce distribution of, preserve, or remove content; limit features; reverse improper rewards or transactions; or suspend or terminate accounts when reasonably necessary.

If you encounter content or a user-created character that you believe is unsafe, unlawful, infringing, impersonating someone, or otherwise violates these terms, use the in-app reporting tool or support channel. Rights holders should provide enough detail to identify the work, the allegedly infringing material, their authority, and a reliable way to contact them. We may preserve and disclose relevant information where required by law.

10. Yovela materials and service license

The Services—including software, interfaces, branding, artwork, documentation, models, systems, and content supplied by Yovela or its licensors—are protected by intellectual-property and other laws. Except for Your Content, Yovela and its licensors retain all rights in these materials.

Subject to these terms, Yovela grants you a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Services for their intended purpose. You may not copy, sell, redistribute, reverse engineer, decompile, extract models or data, remove notices, or create derivative services except where applicable law expressly permits it.

11. Third-party services and content

The Services may depend on app stores, identity providers, payment services, AI providers, links, or content supplied by third parties. Their products and information may be governed by separate terms and privacy policies. Yovela does not control and is not responsible for third-party services, and a link or integration does not imply endorsement. Your use of them is at your own risk, subject to mandatory law.

12. Sparks, purchases, and refunds

Yovela may offer paid digital items, including Sparks. You must have reached the age required to make a purchase in your location or have valid authorization from a parent, guardian, or payment-account holder. Prices, taxes, currency, and included items are shown through the applicable purchase channel before you confirm.

Sparks are a limited, revocable license to use a feature within Yovela. They are not money, stored value, property, or legal tender; do not earn interest; and cannot be transferred, traded, or redeemed for cash unless law requires otherwise. Promotional or included Sparks may have different conditions disclosed when granted.

Purchases are processed by the applicable app store or payment provider and are subject to its billing and refund rules. Except where law or the payment channel requires otherwise, delivered digital items are final. If a purchase is refunded, reversed, fraudulent, or charged back, we may remove the corresponding Sparks or benefits and restrict paid use until any resulting balance issue is resolved. We will not limit rights or remedies that cannot lawfully be excluded.

13. Service changes and availability

We may add, change, suspend, or discontinue features, models, content, prices, or usage limits. We will provide notice where required by law and will not retroactively take away mandatory purchase rights. We may use testing, preview, or beta features that can change or fail and are provided for evaluation.

You are responsible for compatible equipment, software, and network access. We do not promise uninterrupted, secure, or error-free operation, or that story history and generated content will always be available. Keep independent copies of content you need to preserve.

14. Suspension, termination, and account deletion

You may stop using Yovela at any time and may request account deletion through Account Management in the app. We may investigate, limit, suspend, or terminate access for serious or repeated violations, safety or legal risk, fraud, non-payment, harm to service integrity, or prolonged inactivity where disclosed.

Where practical and lawful, we will consider the nature of the issue and may provide notice or an opportunity to appeal. Immediate action may be necessary to prevent harm or comply with law. On termination, your license to use the Services ends. Content and account information are handled under our Privacy Policy, and provisions that by their nature should survive will remain in effect.

15. Disclaimers

To the fullest extent permitted by law, the Services are provided as is and as available. Yovela disclaims implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranty arising from course of dealing. We do not warrant the accuracy, uniqueness, reliability, safety, legality, or suitability of user, third-party, or AI-generated content.

Nothing in these terms excludes warranties, guarantees, or other consumer rights that cannot be excluded under applicable law.

16. Limitation of liability

To the fullest extent permitted by law, Yovela and its affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, goodwill, data, or business opportunity, arising from the Services or content.

Where liability cannot be excluded, Yovela's total liability for claims connected with the Services will not exceed the greater of the amount you paid to Yovela for the Services during the 12 months before the event giving rise to the claim or the minimum amount required by applicable law. These limits do not apply to liability that cannot lawfully be limited.

17. Responsibility for claims

To the extent permitted by law, you are responsible for third-party claims, losses, and reasonable costs caused by your unlawful use of the Services, Your Content, or your material breach of these terms. This does not require you to compensate Yovela for conduct caused by Yovela or for liabilities that cannot lawfully be shifted to you.

18. Changes, disputes, and general terms

We may revise these terms as the Services or law changes. The date above identifies the latest revision. We will provide additional notice of material changes where required. If you continue using the Services after revised terms take effect, the revised terms govern future use; if you do not agree, you must stop using the Services.

Before starting a formal dispute, please contact support and allow a reasonable opportunity to resolve it informally. Applicable law and courts are determined by the Yovela operator and regional terms presented to you, subject always to mandatory consumer protections in your place of residence.

If a provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue. A failure to enforce a provision is not a waiver. You may not transfer this agreement without our consent; Yovela may transfer it as part of a reorganization or business transfer, subject to law. These terms and incorporated policies are the entire agreement about the Services unless separate written terms apply.
